Winter tire law

The Law on Winter Tires is nothing more than the Technical Regulations of the Customs Union. Paragraph 5.5 of Appendix 8 states that it is prohibited to drive on winter tires in the summer and vice versa. Wheels must meet the requirements of subclause 5.6.3. The winter period is considered to be the months from December to February inclusive. Summer period – from June to August. Each region can independently set these deadlines, because climatic conditions are different throughout the country.

Note: tires appropriate for the season must be on two axles of the vehicle, and not on one. Failure to comply with this requirement will be regarded as non-compliance of transport with technical regulations.

Paragraph 5.6.3 contains information that tires with a residual tread depth of no more than 4 mm are unsuitable for use in winter. Provided that the M&S marking and the sign “rock with three peaks, a snowflake inside” are present.

The Code of Administrative Offenses does not have clauses that would allow drivers to be fined for driving a vehicle with tires that are out of season.

Some deputies are only planning to introduce punishment for drivers who do not have time to change tires on time, according to the season. The initiators want to supplement Article 12.5 of the Code with the following content: introduce fines for drivers from traffic police inspectors for driving vehicles that violate the requirements for the operation of wheels. The penalty is 2 thousand rubles.

The amendments were never adopted, so there is no such fine for driving in the summer on winter tires.

How can a traffic police inspector punish a driver for not changing tires on time?

A traffic police inspector for the absence of summer tires from June to August and for the absence of winter tires from December to February may impose a fine of 500 rubles for the following violations:

  • tread depth less than 0.4 cm;
  • if you do not find a sticker “Ш” in a triangle on the rear window, provided that the vehicle is fitted with tires with spikes;
  • cut and/or tear to the cord;
  • different wheels (winter/summer or Velcro) on the same axle and/or lack of fastenings.

Driving on studded tires in the off-season and summer

Driving on studded or summer wheels in the off-season does not constitute any violation on the part of the driver. However, it is advisable to take into account weather changes and change your shoes so that it is safe to drive on the roads.

Winter tires are considered softer and will wear out quickly at above-zero temperatures. Therefore, when steady warming sets in without morning frosts, it is better to immediately switch to summer tires. At low temperatures, winter tires harden slightly. It should be taken into account that such wheels are sometimes equipped with metal spikes. Such inserts provide better control and braking of the car on roads with ice and snow, but on asphalt they spoil the road surface.

A driver who uses studded tires in summer can be fined 500 rubles. The reason is non-compliance with CU standards.

This law does not apply to regions of the country where there is frozen ground and a cold climate most of the year. In these areas it is legal to drive on winter tires not only in winter, but also in other months of the year. At the same time, for these regions the rule of the mandatory presence of the “Ш” sign on the rear window is not excluded.

Fines for out-of-season tires

As such, there is no fine for using winter tires in the summer in the Code of Administrative Offenses. However, this document contains two articles with penalties for the following offenses that relate to the use of tires:

  • 0.8 mm – for cars of category L;
  • 1 mm – for vehicles of categories N2, N3, O3, O4;

  • 2 mm – for cars of category M2, M3.

As for the remaining tread depth on winter tires installed, it should be at least 4 mm.

Failure to comply with these requirements qualifies as using a vehicle with technical defects, therefore, certain liability is imposed for such actions. It is established in accordance with Part 1 of Art. 12.5 of the Code of Administrative Offenses and consists of imposing a fine of 500 rubles.

2. Installation of different types of tires on one car axle, for example: studded and non-studded, with different tread depths, new and worn, not provided by the manufacturer, etc. All this also applies to vehicle malfunctions, therefore the fine is applied in accordance with the same part. 1 tbsp. 12.5 of the Administrative Code in the amount of 500 rubles.

Also, if a driver is involved in an accident, the wrong type of tires can be an aggravating factor if someone is killed or seriously injured as a result of the accident.

Winter tires in summer: risks and possible consequences

Car tires can be divided into summer and winter according to the season in which they can be used. This division is not in vain, because each type of rubber is intended for use only in certain weather conditions. Winter tires cannot be used in summer for several reasons:

  1. At high air and asphalt temperatures, winter tires become very hot, since they are much softer than summer tires. This can cause the tire to become very soft while driving and may even explode.
  2. A studded tire (which is what winter tires are most often like) provides good grip only on slippery roads, that is, on ice and snow. On dry summer asphalt it starts to slip a lot.
  3. Winter tires wear out more when used in summer, and can easily burst if in contact with a sharp object.

IMPORTANT! All this contributes to the creation of an emergency situation and increases the risk to life and health, both of the driver himself and of other citizens: drivers, passengers, pedestrians.

To prevent such a situation and influence drivers to force them to change tires on time, in some cases a fine is imposed for this.

When to wear summer and when to wear winter tires

Regulation of the periods of use of a particular type of tire occurs on the basis of a special regulatory document - the Technical Regulations of the Customs Union “On the Safety of Wheeled Vehicles”. In accordance with Appendix No. 8, which is available in this document, the following requirements for tire seasonality are established:

  1. The use of studded tires is prohibited in the summer, that is, from the beginning of June to the end of August. All other types of tires (all-season, Velcro) can be used at this time. In practice, it is recommended to change tires when the temperature remains above +7 degrees for several days in a row.
  2. It is prohibited to use summer tires in winter, namely from the beginning of December to the end of February. During these months, the driver must use winter tires, regardless of whether they are studded or not. Moreover, if tires with spikes are installed, the driver must warn other road users about this by placing a special sign on the car window.

IMPORTANT! Specific periods for the use of a particular type of tire can be established by individual constituent entities of the Russian Federation, taking into account the climatic conditions of each region.

A flaw in the legislation in this area is that despite the presence of these provisions, the Code of Administrative Offenses does not provide for any liability for their violation. This is partly due to the vastness of the territory of the Russian Federation and the various climatic conditions on it, which is why it is still difficult to establish uniform requirements for the seasonality of tires.

However, proposals to introduce certain measures have been around for a long time, so we can expect some innovations in the next few years. Moreover, this may be not only the fine that in some cases is already applied now, but also refusals to pay insurance in the event of an accident or a significant increase in the amount of fines in all cases of tires not complying with the Technical Regulations.

In 2016, the Russian Government continues to consider the issue of introducing several amendments to Article 12.2 of the Code of Administrative Offenses of the Russian Federation, according to which drivers who drive summer tires in winter will be held administratively liable and obliged to pay a fine. It specifies the maximum permissible tire tread size for use. So, the tread depth of winter tires should be at least four millimeters, and the depth of summer tires should be at least one and a half millimeters. If a driver drives on tires whose thickness is less than permissible, he is subject to a fine of five hundred rubles.

  • Law “On the Safety of Wheeled Vehicles”;

It states that in the winter (from about mid-November to March) drivers must drive on winter tires, and in the summer (from mid-May to August) they must use summer tires. However, no mention is made of what fine the driver will have to pay for winter tires in the summer (or summer tires in the winter).

At the moment, the above Laws are the only legal basis that traffic police officers use (not always legally) when “catching” road violators on out-of-season tires.


Penalty for using summer tires

Article 12.2 of the Code of Administrative Offenses does not say that using summer tires in winter weather may result in a fine.

However, the Law “On the Safety of Wheeled Vehicles” specifies the periods of the year when the use of summer tires is legal:

  • During the summer period from June to August, drivers should only drive on summer tires;

In addition, in the summer it is allowed to use winter tires without studs (which are generally considered universal).

Summer tires can also be used from March to May and from September to November.

When is it customary to “change shoes” from winter tires to summer ones? After the winter period (depending on the region), it is best to “put on” summer tires in mid-March. However, this does not apply to regions of Russia in which periods of cold weather prevail (in the northern part of the country). Therefore, despite the recommended timing for changing tires, most drivers rely on the weather.

Can a driver get a fine for using summer tires in winter? According to Article 12.2 of the Code of Administrative Offenses, no. Road inspectors have the right to warn the driver about the possible negative consequences of using unsuitable tires and recommend changing them. However, for using worn summer tires, the driver can receive a fine of five hundred rubles.

Penalty for using winter tires

There is also no fine for using winter tires in the summer in 2016.

The Law “On the Safety of Wheeled Vehicles” specifies periods when the use of winter tires is legal. So:

  • From December to February, drivers must drive on winter tires (studded or demi-season);

In addition, studded winter “footwear” can be used from September to November and from March to May.

Studless winter tires can be used all year round.

What fines can be introduced?

At the moment, the Russian Government is considering introducing amendments to Article 12.2 of the Code of Administrative Offences, according to which the driver will have to pay a fine of two to five thousand rubles for using tires out of season. However, these amendments have not yet been introduced.

As the winter season approaches, many motorists are afraid of getting a fine for winter tires or the lack of them. The need to switch to seasonal tires is due to weather conditions in Russia. But is there a fine for winter tires? Is it possible to get a fine for summer tires in winter? What are the risks for drivers when using out-of-season tires? What legislation regulates these issues?

When and why to switch to winter tires?

Most of the territory of Russia is located in the temperate zone, the northern continental territories are in the subarctic. Some regions located in the temperate zone are characterized by a clear division of seasons. In winter there is constant snow cover and the average air temperature drops below zero. In such conditions, the road surface is mostly icy or snowy; therefore, for safe driving, you must have special winter tires. They allow drivers to effectively maneuver on the road, reduce braking distances, improve traction with the road surface, and together contribute to driving safety in winter. This happens due to the following points:

  • Winter tires are made from a soft rubber compound that becomes flexible at low temperatures. This type of rubber has a high level of wear resistance;
  • Winter tires have a special tread pattern (asymmetrical, V-shaped, etc.), which ensures tighter contact between the road and the wheels, promotes better cross-country ability in snowy roads and guarantees effective braking;
  • Rubber micropores (depending on the manufacturer) allow tires to effectively absorb moisture (including from the surface of ice), which ensures good grip;
  • The studs found on some winter tires are designed to resist skidding. Their use will be effective outside the city on roads and highways that are rarely cleared of snow and have a smooth (ice or snow) surface.

Most drivers do not know what the fine is for not having winter tires in winter and, in order to avoid sanctions, change tires in advance. But the transition to winter tires, as a process that helps ensure road safety, is beneficial to the motorist himself. By changing summer tires to winter ones, he reduces the likelihood of getting into an accident due to weather conditions and road surface, thereby “saving” himself and other drivers from injuries and damage that may occur during accidents. There are no provisions in federal legislation on the transition to winter tires, but the Technical Regulations “On the Safety of Wheeled Vehicles,” which are in force in the countries of the Customs Union, oblige all drivers to make such a replacement. Several times in the history of Russian lawmaking, proposals were made to introduce a fine for the lack of winter tires, but by 2018, none of the proposed laws had been adopted. The last one put forward for consideration was bill No. 464241-6, which proposed establishing a fine of 2,000 rubles. But during the first reading in the State Duma, the initiator of the bill withdrew it from consideration due to amendments to the Technical Regulations clarifying the responsibilities of drivers for seasonal tire changes.

Thus, Appendix No. 8 of the regulations states that studded tires cannot be used during the three summer months. But the fine for winter tires in summer is not established by the Code of Administrative Offenses of the Russian Federation. Cars of categories “M1”, “N1” (passenger cars and trucks up to 3.5 tons) must be equipped with studded tires for 3 months of winter. It is possible that legislation may change the timing of the ban based on the climatic characteristics of a particular region. Traffic police officers should also not issue a fine for summer tires in winter in 2018, since there is no such rule in either the Traffic Regulations or the Code of Administrative Offences, the provisions of Chapter 12 of which are based precisely on the Traffic Rules.

Despite the absence of a statutory penalty for one type of tire or another in different seasons, every motorist must understand that he is responsible for what happens on the roads and highways. For the sake of your safety and the safety of others, it would be wisest to “change your shoes” to winter tires. When to do this depends on the territory where the vehicle is used. In some regions, snow may fall as early as September, in others it will not even fall in December.

Features of using all-season tires

All-season tires were developed as a compromise between winter and summer tires. Re-equipping a vehicle with tires in the cold season is an expensive pleasure. Especially for car owners who live in the southern regions, where winter is short. Rubber manufacturers were looking for a general solution in which all-season tires would retain the important characteristics of winter and summer tires - contact with the road surface, tread depth, special tire pattern, etc. All-season tires have the following qualities:

  • The tread pattern is asymmetrical, most often diamonds and rectangles in the center, and lines (longitudinal or transverse) on the sides. That is, the central part of the tire resembles a winter pattern, and the part located closer to the inside of the wheel resembles a summer pattern;
  • Tread depth is a cross between winter (up to 4 mm) and summer (up to 1.6 mm) characteristics and may vary depending on the manufacturer.

Despite the seemingly obvious advantages associated with savings, all-season tires have a number of disadvantages. The first of them is the limited temperature range of use. Such tires will not be effective at temperatures below -7°C and ineffective at temperatures above +15°C. They will wear out much faster if the vehicle is used for a whole year. Grip on a road covered with loose snow, slush or ice will be practically zero. All this allows us to conclude that it is not advisable to use vehicles equipped with such tires in regions with hot and extremely cold climates. Traffic police inspectors will not issue a fine for driving without winter tires to the owner of a car with all-season tires, but the quality of operation of vehicles with such tires allows one to speak out more against than for.

Fines for improper use of tires in 2018-2019.

The Code of Administrative Offenses of the Russian Federation does not provide for penalties for unspecified seasonal tires in summer or winter. As winter approached, news began to appear in the media that a fine for winter tires had been established from December 1, 2018. They were not true, but prompted many drivers to install new tires that meet seasonal requirements even before the first snow. Such news was partly fabricated or based on the provisions of the Technical Regulations, but was not supported by the norms of Russian legislation. In accordance with Article 12.5 of the Administrative Code, a motorist can be fined only for non-compliance of the wheels with the parameters stated in paragraph 5 of the “Basic provisions for the approval of a vehicle for operation.” But even at this point there is not a word about the need to switch from summer tires to winter ones.

For summer tires in winter

Many motorists who are new to the law believe that they can get a fine for summer tires from November 1. That is, if after this date winter tires are not installed on the car, traffic police inspectors will have every right to issue a resolution on an administrative violation. But this is not a violation. Such misconceptions may be due to the fact that, according to an unspoken rule, the transition to winter tires occurs in November.

For winter tires in summer

The use of winter tires (especially studded ones) in summer is contraindicated for several reasons. This tire is made of soft elastic rubber that is in close contact with the road surface. If such a coating is dry asphalt, the tire will heat up, the car will become difficult to control, and this can lead, at best, to cracks in the wheel, at worst, to a rupture.

Studded tires can easily damage dry road surfaces, but this is not the worst thing for the driver. Driving on summer roads on a vehicle equipped with such tires can be compared to driving on ice on summer tires - unpredictable and unsafe. The Code of Administrative Offenses does not provide for a fine for winter tires, but the traffic police can check the level of wear, which, with such use, can increase sharply in a short time.

For bald tires

The fine for using worn-out winter tires is 500 rubles in accordance with clause 1 of Article 12.5 of the Administrative Code. The level of wear is determined according to the standards of the “Basic Provisions...”. When driving on snowy or icy surfaces on winter tires marked with a snowflake, the tread depth cannot be more than 4 mm. If the depth of the drawing does not meet the standards, then the traffic police will have every reason to draw up a protocol and a resolution.

For different tires

In accordance with the same norm of the Code of Administrative Offenses, a vehicle driver can be punished for using different tires installed on the same axle. The fine for winter tires and summer tires installed at the same time, for the simultaneous use of studded and non-studded tires, tires of different sizes and with excellent designs, etc., is 500 rubles.

Exact dates

Why is it prohibited to use summer tires in cold weather conditions:

  • The braking distance increases significantly because the tires are not suitable for driving on snow and ice:
  • road traction is reduced, therefore the maneuverability of the vehicle is reduced:
  • tires wear out quickly because the rubber is not designed to withstand sharp ice and cold snow.
